Melanoma Dominates Skin Cancer Malpractice Cases Over 95 Years

A comprehensive review of physician-related malpractice cases from 1930 to 2025 reveals that melanoma is the most frequently litigated skin cancer, with a staggering 49.5% of cases. The study, published in the Journal of the American Academy of Dermatology, highlights the devastating impact of diagnosis failures and delays, which were the primary allegations in nearly two-thirds of the cases, resulting in documented deaths in almost one-third.

The research, led by Dr. Ghassan Barnawi, analyzed 188 unique cases, uncovering a disturbing trend. Melanoma cases were predominantly associated with metastatic disease (39.9%) and death (29.8%). The most common allegations were failure or delay in diagnosis (38.1%), treatment or management errors (24.2%), and misdiagnosis (11.4%).

Family physicians were the most frequently named defendants (27.5%), followed by dermatologists (20.1%), pathologists or dermatopathologists (14.4%), and general or plastic surgeons (7.9%). Most cases (59.7%) originated in private practices, with New York and California leading the way in case volume.

The study's findings underscore the critical need for improved diagnostic accuracy and timely treatment in skin cancer management. The authors emphasize that this review provides a pragmatic assessment of real-world litigation exposure, offering valuable insights into the clinical scenarios that expose physicians to legal risks, financial burdens, reputational damage, and psychological strain, regardless of case outcome.

However, the study's reliance on published court decisions may underestimate the true malpractice burden, as it excludes settlements and unreported claims. Despite this limitation, the research highlights the urgent need for enhanced diagnostic and treatment practices in skin cancer management to reduce the devastating impact of malpractice cases.
